Welcome to Kavgamiz Games. These Terms and Conditions (“Terms”) are an agreement between you and Kavgamiz (“Kavgamiz”, “we”, “our”) and apply whenever you use kavgamiz.com/games (the “Service”). Using the Service means you accept these Terms. If you do not accept them, do not use the Service. Anyone under 18 should read these Terms with a parent or guardian.

1. About the Service

Kavgamiz Games lets you play free online games in your web browser. The games are made by independent developers and distributors, and most are loaded from their servers into a frame on our pages. The Service is free: we have no paid plans, shop or in-game purchases.

2. Accounts

An account is not required to play. You must be 13 or older to register. Keep your login details private. You are responsible for what happens under your account. We can suspend or remove any account that violates these Terms or that we have reason to believe belongs to a child under 13.

3. Rules of conduct

You must not use the Service to:

  • post anything abusive, hateful, harassing, sexual, violent, threatening or illegal
  • reveal personal information about yourself or others, including real names, home or school addresses, phone numbers or pictures
  • spam, advertise or post links to outside websites
  • pretend to be someone else
  • cheat, manipulate ratings or leaderboards, or use automated tools or bots
  • interfere with, overload, scrape or hack the Service
  • break the rules of the school, employer or network you are using

4. Content you post

Comments and other material you submit remain yours. You grant Kavgamiz a worldwide, non-exclusive, royalty-free license to host, display, copy and distribute them as part of the Service, and you promise you have the right to post them. We may remove any submission at our discretion, especially if it breaks these Terms.

5. Ownership

Each game, together with its title, characters, logos and artwork, is the property of its developer, publisher or other owner. The Service’s own design, text and selection of content belong to Kavgamiz. You may play the games and link to our pages, but you may not copy, download, re-host or sell any game or Service content without the owner’s permission.

6. DMCA copyright notices

Kavgamiz responds to copyright notices under the Digital Millennium Copyright Act. To report infringing material, email [email protected] with the subject line “DMCA Notice” and include:

  1. a physical or electronic signature of the copyright owner or authorized agent
  2. identification of the copyrighted work
  3. the page address where the material appears on the Service
  4. your name, mailing address, phone number and email address
  5. a statement of your good-faith belief that the use is not authorized by the owner, its agent or the law
  6. a statement, made under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner

After receiving a valid notice we will remove or block the material. Users whose content was removed may send a counter-notice to the same address. Accounts of repeat infringers may be terminated.

7. Third-party content

Games, ads and outside links on the Service may come from third parties. Kavgamiz does not control them and is not responsible for their content, availability, chat functions or data practices, which may be governed by their own terms. Our Privacy Policy explains more.

8. No warranties

THE SERVICE AND ALL GAMES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE OR ANY GAME WILL ALWAYS BE AVAILABLE, WORK WITHOUT ERRORS OR BE FREE OF VIRUSES OR OTHER HARMFUL CODE.

9. Limits on liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, KAVGAMIZ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA OR PROFITS, RESULTING FROM YOUR USE OF THE SERVICE OR ANY GAME. SINCE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO IT IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100). SOME STATES DO NOT PERMIT THESE LIMITS, IN WHICH CASE THEY MAY NOT APPLY TO YOU.

10. Indemnification

To the extent permitted by law, you will indemnify and hold Kavgamiz harmless against any claims, damages and costs, including reasonable legal fees, that result from your submissions or your breach of these Terms.

11. Changes, suspension and termination

We may modify, pause or stop any part of the Service at any time. These Terms may also be updated, and the effective date above identifies the current version. If you keep using the Service after a change, you accept the revised Terms. We may restrict or end your access if you violate them.

12. Miscellaneous

These Terms are governed by the laws of the United States and of the state in which Kavgamiz is established, without applying conflict-of-law principles. If a court finds any provision unenforceable, the remaining provisions continue to apply. Not enforcing a provision does not waive our right to enforce it later. These Terms and our Privacy Policy form the complete agreement between you and Kavgamiz regarding the Service.
